Terms and Conditions for Clients with Ama-gi Technologies Inc.

These Terms and Conditions (“Agreement”) govern the provision of home care services by Ama-gi Technologies Inc. (“Ama-gi”) to individuals or entities (“Client”) seeking such services. By engaging with Ama-gi’s home care services, the Client agrees to be bound by these terms. If you do not agree to these terms, please do not use our services.

  1. Scope of Services: Ama-gi Technologies Inc. agrees to provide home care services to the Client as outlined in the agreed-upon service plan. The Client is responsible for obtaining any equipment and Internet service necessary to access the Ama-gi application and for paying any fees for the equipment and service you select.
  2. Website Content: Users have a personal, non-transferable, non-exclusive right to access and use the Content of the Ama-gi website and application subject to these Terms and Conditions. The term ‘Content’ means all information, text, images, data, links, software, or other materials accessible through the Ama-gi website and application or services.
  3. Registration: Certain Services are reserved for registered users. In order to become a registered user (each, a ‘Client’ or ‘Caregiver’, also known as ‘Care Ambassador’), we will ask you to complete the registration process and provide a username or email and create a password (“Login Credentials”). As a registered user of Ama-gi, you agree to receive emails promoting any special offer(s), including third-party offers.
  4. Client Responsibilities: a. The Client or Care Ambassador agrees to provide accurate and complete information about their health, medical history, and any specific requirements relevant to the provision of home care services. b. The Client shall provide a safe and suitable environment for the delivery of home care services. Clients shall provide caregivers with safe and unobstructed access to their homes during scheduled service hours.
  5. Cooperation: Clients agree to cooperate with caregivers and provide accurate and complete information about their health, medical history, and any specific requirements relevant to the provision of home care services.
  6. Communication: Clients are encouraged to communicate openly with caregivers and provide feedback or report any concerns promptly to Ama-gi for resolution.
  7. Confidentiality: Ama-gi Technologies Inc. and its caregivers will maintain the confidentiality of the Client’s personal and health information in accordance with applicable privacy laws.
  8. Subscription: You will automatically be charged each month for your ongoing subscription. If you have committed to a subscription plan lasting longer than one month (i.e. semi-annual or annual month plans), you will automatically be charged each month during that subscription period. For semi-annual and annual periods, if a subscription is cancelled during the subscription period, the plan will automatically revert to a monthly plan, and you will be responsible for paying the difference between the two plans. To cancel, you must log in and cancel the subscription on the Ama-gi Platform. The subscription will continue for the remainder of the month, and the cancellation will take effect the following month.
  9. Payment: a. The Client agrees to pay the fees for the home care services as outlined in the agreed-upon service plan. b. Payment is due in accordance with the agreed-upon billing schedule. We reserve the right to change our fee structure at any time, except for the subscription fees applicable to any then-current-bearing subscription period. We also reserve the right to initiate special incentive pricing, membership, and other programs, which may be limited, at our sole discretion, to defined and limited existing users or new users. You also agree to pay the applicable fees for such Services (including, with limitation, periodic fees for subscription) as they become due, plus all related taxes.
  10. Cancellation and Rescheduling: a. The Client agrees to provide reasonable notice for cancellations or rescheduling of home care services. b. Ama-gi Technologies Inc. reserves the right to charge a cancellation fee for appointments canceled without sufficient notice.
  11. Quality of Care: a. Ama-gi Technologies Inc. will make reasonable efforts to ensure the quality and reliability of home care services. b. The Client is encouraged to provide feedback and report any concerns promptly.
  12. Termination: Either party may terminate the agreement with written notice. b. Ama-gi Technologies Inc. reserves the right to terminate services immediately if the Client engages in abusive or threatening behavior towards Ama-gi or its Caregivers.
  13. Liability: Clients acknowledge that Ama-gi is not liable for any damages or injuries resulting from their failure to follow care recommendations or restrictions.
  14. Governing Law: This Agreement shall be governed by and construed in accordance with the laws of the state where the home care services are provided.
  15. Amendments: Clients will be notified of any material changes to these terms and conditions. Continued use of Ama-gi’s home care services constitutes acceptance of the updated terms.

Terms and Conditions for Caregivers with Ama-gi Technologies Inc.

These Terms and Conditions (“Agreement”) outlines the obligations and expectations for caregivers (“Caregivers”) engaging with home care services provided by Ama-gi Technologies Inc. (“Ama-gi”). By participating in Ama-gi’s home care services, Caregivers agree to abide by these terms. Failure to comply with these terms may result in termination of engagement with Ama-gi.

  1. Scope of Services: Ama-gi Technologies Inc. agrees to provide home care services to the Client as outlined in the agreed-upon service plan. Caregivers are responsible for ensuring they have the necessary equipment and internet service to access the Ama-gi application and for any associated fees.
  2. Website Content: Users have a personal, non-transferable, non-exclusive right to access and use the Content of the Ama-gi website and application subject to these Terms and Conditions. The term ‘Content’ means all information, text, images, data, links, software, or other materials accessible through the Ama-gi website and application or services.

  6. Background Check: All caregivers must consent to and pass a comprehensive background check before being approved to offer services through our platform. This check may include criminal history, reference checks, and other relevant screenings.
  7. Insurance Coverage: Caregivers are responsible for maintaining appropriate insurance coverage, including liability insurance, to protect themselves and the clients they serve.
  8. Professional Conduct: Caregivers are expected to conduct themselves in a professional manner at all times when interacting with clients and their families. This includes maintaining confidentiality, respecting privacy, and adhering to the client’s care plan and instructions.
  9. Valid Identification: Caregivers must possess and maintain valid identification documents, such as a driver’s license or passport, which will be verified during the onboarding process.
  10. Caregiver Responsibilities: Caregivers must ensure accuracy and completeness in the information on the Ama-gi platform.
  11. Continuing Education: Caregivers are encouraged to pursue continuing education and professional development opportunities to enhance their skills and stay updated on best practices in caregiving.
  12. Safety Precautions: Caregivers are responsible for ensuring the safety and well-being of their clients at all times. This includes following proper protocols for infection control, medication management, and emergency procedures.
  13. Communication: Caregivers must maintain open and transparent communication with clients and their families regarding the care provided, any changes in the client’s condition, and any concerns or issues that may arise during the course of their work.
  14. Adherence to Regulations: Caregivers must comply with all applicable laws, regulations, and industry standards governing the provision of caregiving services in their jurisdiction.
  15. Confidentiality: Caregivers are obligated to maintain the confidentiality of clients’ personal and health information in accordance with applicable privacy laws.
  16. Subscription and Payment: Caregivers acknowledge that payment for services is received through the Ama-gi platform according to agreed-upon rates and billing schedules. Any changes to fees or billing structures will be communicated in advance.
  17. Cancellation and Rescheduling: a. Caregivers must provide reasonable notice and reason for cancellations or rescheduling of home care services. B. Ama-gi reserves the right to charge a cancellation fee for appointments canceled without sufficient notice.
  18. Quality of Care: Ama-gi is committed to ensuring the quality and reliability of home care services. Caregivers are encouraged to actively seek feedback from clients and promptly address any concerns.
  19. Termination of Services: Caregivers may have their access to our platform terminated if they fail to comply with these terms and conditions or if their conduct is deemed inappropriate or detrimental to the well-being of clients.
  20. Liability: Ama-gi shall not be held liable for damages or injuries resulting from a Caregiver’s failure to adhere to care recommendations or restrictions.
  21. Governing Law: This Agreement shall be governed by and construed in accordance with the laws of the state where the home care services are provided.
  22. Modification of Terms: We reserve the right to modify or update these terms and conditions at any time, and caregivers will be notified of any changes accordingly.

By engaging with Ama-gi’s home care platform, Caregivers agree to these terms and conditions, caregivers acknowledge their commitment to providing high-quality, compassionate care to the clients they serve while upholding the highest standards of professionalism and integrity.
